Copyright Infringement Policy

1. Introduction
InfoQuest Technologies, Inc. (“InfoQuest,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects customers, users, resellers, and visitors who use InfoQuest services to do the same.
This Copyright Infringement Policy explains how copyright owners may submit notices of alleged copyright infringement and how affected customers may submit counter-notifications under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
This policy applies to websites, files, email, hosting services, servers, customer content, and other materials hosted, stored, transmitted, or made available through InfoQuest services.
2. DMCA Designated Agent

InfoQuest may require additional verification before acting on a notice that appears incomplete, fraudulent, unverifiable, automated, misleading, or inconsistent with the requirements of the DMCA.
3. Submitting a Copyright Infringement Notice
To submit a DMCA notice, you must provide a written communication that includes substantially all of the following information:

Your physical or electronic signature.
The notice must be signed by the copyright owner or by a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Identification of the copyrighted work.
Identify the copyrighted work you claim has been infringed. If multiple copyrighted works at a single online site are covered by one notice, you may provide a representative list of those works.

Identification of the allegedly infringing material.
Identify the material that you claim is infringing or is the subject of infringing activity, and provide information reasonably sufficient to permit InfoQuest to locate the material.
Please provide the specific URL or location for each item you claim is infringing. General references to a website, domain name, customer account, or server are usually not sufficient.
Example:

Your contact information.
Provide information reasonably sufficient to allow InfoQuest to contact you, including your full legal name, mailing address, telephone number, and email address.

Information for the affected customer, if available.
If possible, provide information that may help InfoQuest notify the owner, administrator, or customer responsible for the allegedly infringing material.

Good-faith statement.
Include the following statement:
I have a good faith belief that use of the copyrighted material described above in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Accuracy and authority statement.
Include the following statement:
I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
DMCA notices that do not include the required information may be rejected, delayed, or returned for correction.
4. Important Warning About Misrepresentation
Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys’ fees. If you are unsure whether material infringes your copyright, you should consult an attorney before submitting a notice.
5. InfoQuest Response to Notices
When InfoQuest receives a complete and valid DMCA notice, we may remove or disable access to the allegedly infringing material, suspend or restrict the affected service, notify the customer, and take other action we determine appropriate under the circumstances.
InfoQuest may act promptly to remove or disable access to material identified in a valid notice. The U.S. Copyright Office explains that service providers seeking safe harbor must act expeditiously after receiving a compliant notice. ([copyright.gov](https://www.copyright.gov/512/))
InfoQuest may forward a copy of the notice to the affected customer, account holder, website owner, reseller, or other relevant party. We may also provide the notice to third parties, publish it, or document it as part of our abuse handling, legal compliance, or transparency processes.
6. Customer Notification
If InfoQuest removes or disables access to material in response to a DMCA notice, we will make a good-faith attempt to notify the affected customer, website owner, or account administrator using the contact information available to us.
The affected customer may have the right to submit a counter-notification if the customer believes the material was removed or disabled as a result of mistake or misidentification.
7. Counter-Notification Procedure
If you are an InfoQuest customer and believe that your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to InfoQuest’s designated agent.
A valid counter-notification must include substantially all of the following information:

Your physical or electronic signature.

Identification of the removed or disabled material.
Identify the material that was removed or disabled and the location where the material appeared before it was removed or access was disabled.

Statement under penalty of perjury.
Include the following statement:
I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

Your contact information and consent to jurisdiction.
Provide your full legal name, mailing address, telephone number, and email address.
Include the following statement:
I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside the United States, to the jurisdiction of any judicial district in which InfoQuest may be found. I will accept service of process from the person who provided the original DMCA notification or an agent of that person.
8. Restoration of Material After Counter-Notification
After receiving a valid counter-notification, InfoQuest may forward it to the party who submitted the original DMCA notice.
Under the DMCA process, access to the removed material may be restored after the required waiting period unless the original complaining party notifies InfoQuest that it has filed a court action seeking to restrain the customer from engaging in infringing activity. The Copyright Office describes this period as no less than ten and no more than fourteen business days after receipt of a compliant counter-notice. ([copyright.gov](https://www.copyright.gov/512/))
InfoQuest may decline to restore material if doing so would violate law, court order, InfoQuest policy, third-party provider rules, security requirements, or other applicable obligations.
9. Repeat Infringer Policy
InfoQuest may terminate, suspend, restrict, or refuse service to customers, users, or accounts that InfoQuest determines are repeat infringers or are repeatedly the subject of valid copyright complaints.
InfoQuest may also terminate or restrict services for customers who use InfoQuest services to facilitate copyright infringement, evade enforcement, repost removed material, or interfere with InfoQuest’s copyright complaint process.
10. Incomplete, Fraudulent, or Abusive Notices
InfoQuest may reject, ignore, delay, or request clarification for notices that are incomplete, inaccurate, abusive, automated, unverifiable, misleading, fraudulent, or not submitted by the copyright owner or an authorized agent.
InfoQuest may require additional verification when a notice appears suspicious, when the sender’s identity cannot be confirmed, or when the notice does not provide enough information to locate the allegedly infringing material.
11. No Legal Advice
This policy is provided for informational and administrative purposes only and does not constitute legal advice. Copyright owners and affected customers should consult qualified legal counsel regarding their rights and obligations under copyright law.
12. Changes to this Policy
InfoQuest may revise this Copyright Infringement Policy at any time. Updates will be posted on the InfoQuest website or otherwise made available through InfoQuest’s normal communication methods.
Continued use of InfoQuest services after changes are posted constitutes acceptance of the updated policy.
